coronavirus update - new measures

Dear clients,

We bring you a list of newly issued extraordinary and crisis measures:

Crisis Measure no. 1021 - full text available here:

from 14th October 2020 (00:00 a.m.) to 3th November 2020 (11:59 p.m.)

PROHIBITS:

  • collective events with more than 6 persons (indoors / outdoors) - if they are not members of the household, except:

- employees performing work for the same employer;

- persons pursuing a business or other similar activity jointly;

- persons who jointly perform activities to which they are obliged by law, and it is necessary to carry out the activity in a higher number of persons;

  • persons participating in mass events - the obligation to keep a distance of at least 2 meters from other persons;
  • the prohibition also applies to services, religious ceremonies, festivities, dance events, association events, sports events, parades and tastings;
  • the prohibition does not apply to meetings, sessions and similar events of constitutional bodies, public authorities, courts and other bodies governed by public law or persons established by law, which are held by law, and political parties and movements; the public in the number of 100 people; wedding, declaration of persons entering into a registered partnership, funeral (related celebrations and funerals - only until 00:00);
  • stay in public places in groups of more than 6 people - exception - household members, occupation, business or other similar activity, participation in the wedding, declaration of entry into a registered partnership, funeral (if possible, it is necessary to maintain contact at least 2 meters apart);
  • drinking alcohol in public places;
  • others - concerts, music, theater, film and other artistic performances (incl. circuses and variety shows); joint singing of more than 5 people indoors; pilgrimages and similar traditional events; congresses and other educational events; trade fairs; operation of casinos; operation of indoor sports grounds; operation and use of artificial swimming pools; wellness incl. sauna; solariums; salt caves; visits and tours of zoos; visits and tours of museums, galleries, exhibition spaces, castles, chateaux and similar historical or cultural objects, observatories and planetariums; facilities for persons aged 6 to 18 (hobby, educational, recreational or educational activities).

RESTRICTS:

  • operation of catering services - prohibition of public presence (exception - establishments not serving the public - employee catering; establishments of accommodation establishments, for hotel guests only, from 6:00 am to 8:00 pm; dispensing windows - ban only from 20:00 to 6:00 - all in compliance with other operational measures);
  • music, dance, gaming and similar clubs and discos - no public presence;
  • activity of shopping centres (with a sales area of more than 5.000 m2):

- resting places - cannot be gathered;

- WI-FI shutdown;

- at least 1 person supervising compliance;

- informing customers of measures and obligations to comply with 2 m spacing;

- avoid crowding – toilets, escalators, underground garages, elevators etc.

  • the right to assemble peacefully - max. 500 participants in the assembly; groups of up to 20 persons; intervals between groups of at least 2 metres; each participant shall be required to have a respiratory protective device.
  • from 19. 10. 2020 (00:00 hrs). - Attendance at a wedding, declaration of entry into a registered partnership, funeral (follow-up celebration, wake) - Attendance of a maximum of 30 persons; follow-up events only until 00:00.

from – 14th October 2020 (00:00 hrs) until further notice

  • in all interior spaces of buildings, outside the residence or place of accommodation (e.g. hotel room);
  • in public transport areas;
  • on the platform, in the shelter and waiting room of public transport.

some exceptions:

- staff members and persons in a similar position, including constitutional officials, for the duration of their work in one place, where such a person works at a distance of at least 2 metres from another person;

- Persons working in the III or IV group for risk factor - heat load

At the same time, crisis measure No. 1022 was issued (available here) for the blanket closure of schools and educational establishments.

With the closure of the schools there is a right to sickbay, which in our opinion belongs in this situation under Act No. 133/2020 Coll., per child up to the age of 13 years. In that part, the law extending the entitlement to sickbay in the spring was not limited in time and is to be activated in the event of emergency and crisis measures by the government in 2020, which will result in the closure of schools.

However, MPSV and ČSSZ have so far presented entitlement to sickbay at the closure of schools only for children under 10 years of age. The question is therefore whether this is merely an inconsistency and omission or whether this interpretation is based on sources which are not yet publicly available.
